Terms of Service

1. Description of Service

TravelSmart is an AI-powered travel itinerary planning platform. We use artificial intelligence and third-party data sources to generate personalised travel recommendations, including itineraries, venue suggestions, flight options, accommodation options, and destination guides.

Important: all itineraries and recommendations generated by TravelSmart are suggestions only. They are produced by AI and may contain errors, including incorrect opening hours, outdated pricing, closed venues, or inaccurate directions. You are solely responsible for independently verifying all information before making travel decisions or bookings.

2. Eligibility

You must be at least 16 years old to create an account and use TravelSmart. If you are under 18, you represent that you have obtained consent from a parent or legal guardian to use the service. By using TravelSmart, you represent and warrant that you meet these eligibility requirements.

3. Your Account

Account Creation

You must provide accurate and complete information when creating your account, including a valid email address. You are responsible for keeping your account information up to date.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at iason@travelsmart.global if you suspect unauthorised access to your account.

Account Termination

You may delete your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms, with or without notice.

4. Acceptable Use

You agree to use TravelSmart only for its intended purpose — personal travel planning. You agree not to:

• Abuse the service: do not attempt to overload, disrupt, or interfere with TravelSmart's infrastructure, including circumventing rate limits or access controls.
• Automate access: do not use bots, scrapers, or automated tools to access TravelSmart beyond normal usage, unless explicitly authorised by us.
• Reverse engineer: do not attempt to reverse engineer, decompile, or extract the source code, algorithms, or AI prompts used by TravelSmart.
• Resell or redistribute: do not resell, sublicence, or commercially redistribute itineraries, content, or data generated by TravelSmart without our written consent.
• Misrepresent identity: do not create accounts using false information, impersonate others, or create multiple accounts to circumvent restrictions.
• Interfere with others: do not interfere with other users' access to or enjoyment of the service.
• Violate laws: do not use TravelSmart for any purpose that violates applicable local, national, or international laws or regulations.

Rate Limiting

To ensure fair access for all users, TravelSmart enforces rate limits on API requests, itinerary generation, and AI chat interactions. Exceeding these limits may result in temporary throttling or suspension of access. Rate limits vary by plan tier and are subject to change.

5. Intellectual Property

Our Content

TravelSmart, its design, features, branding, and underlying technology (including AI prompts, algorithms, and pipeline architecture) are owned by TravelSmart Global and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of TravelSmart without our written consent.

Your Content

You retain ownership of any content you create or upload to TravelSmart, including trip preferences, notes, and venue ratings. By using TravelSmart, you grant us a limited, non-exclusive licence to use your content solely for the purpose of providing and improving the service.

AI-Generated Content

Itineraries, destination guides, venue descriptions, and other content generated by TravelSmart's AI are provided for your personal use. You may share, export, and use AI-generated itineraries for your own travel planning. You may not systematically extract, resell, or commercially redistribute AI-generated content.

Third-Party Content

TravelSmart displays content from third-party sources, including venue photos (Google Places), destination images (Unsplash), and flight/accommodation data (SearchAPI). This content is subject to the respective third party's terms and licensing. We do not claim ownership of third-party content.

6. AI Disclaimer

TravelSmart uses artificial intelligence extensively. You acknowledge and agree that:

• AI is not infallible. AI-generated itineraries may contain factual errors, outdated information, or impractical suggestions. Venue opening hours, prices, reservation requirements, and availability change frequently and may not be reflected accurately.
• AI is not a travel agent. TravelSmart does not make bookings on your behalf (except where explicitly stated), does not guarantee availability of any venue, flight, or accommodation, and is not responsible for the quality, safety, or suitability of any recommended venue or service.
• You are responsible for verification. Before travelling, you should independently verify all critical details, including opening hours, ticket availability, visa requirements, travel advisories, and health and safety information.
• AI content does not constitute professional advice. TravelSmart does not provide medical, legal, financial, or safety advice. Consult appropriate professionals for travel insurance, visa requirements, and health precautions.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• TravelSmart is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of TravelSmart, including but not limited to: travel disruptions, cancellations, or delays; closed venues, incorrect opening hours, or unavailable reservations; inaccurate directions, transit times, or distance estimates; financial losses from reliance on AI-generated recommendations; or loss of data due to service interruptions or account deletion.
• Our total liability to you for all claims arising from or related to these Terms or your use of TravelSmart shall not exceed the amount you have paid us in the 12 months preceding the claim, or USD $50, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless TravelSmart Global, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of TravelSmart, your violation of these Terms, or your violation of any rights of a third party.

9. Third-Party Services and Links

TravelSmart integrates with and displays information from third-party services (Google Maps, airline search providers, accommodation platforms, etc.). We are not responsible for the accuracy, availability, or quality of third-party content or services. Your use of third-party services is governed by their respective terms and privacy policies.

Links to external websites (venue websites, booking platforms, airline sites) are provided for convenience only. We do not endorse or assume responsibility for the content or practices of linked websites.

10. Beta Service

TravelSmart is currently in public beta. During the beta period:

• Features may be added, modified, or removed without prior notice.
• The service may experience downtime, bugs, or performance issues.
• Data handling practices may evolve as the platform matures.
• We may reset, migrate, or restructure data as needed for development purposes, with reasonable notice to affected users.

Your use of the beta service is voluntary. We appreciate feedback and encourage you to report issues to iason@travelsmart.global.

11. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the “Last updated” date at the top of this page.
• We will notify registered users via email or an in-app notification at least 14 days before changes take effect.
• Your continued use of TravelSmart after the effective date of changes constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you may delete your account before the changes take effect.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of TravelSmart shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TravelSmart Global regarding your use of TravelSmart, and supersede any prior agreements or understandings.
